These Emerald Communities Terms of Use (“Terms”) are a legal agreement between you and Emerald Communities (“EC,” “we,” or “us”) that governs your access to and use of websites, applications, text messaging services, and other communications provided by EC (collectively, the “Site”).

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SITE OR OPTING IN TO RECEIVE TEXT MESSAGES, YOU AGREE TO BE BOUND BY THESE TERMS.

1. SMS / TEXT MESSAGING TERMS & CONDITIONS

By providing your phone number and opting in via our forms, you agree to receive transactional and/or promotional text messages from Emerald Communities regarding updates, service notifications, technical inquiries, and promotional information.

• Opt-Out: You can cancel the SMS service at any time by texting STOP to our number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
• Help/Support: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or contact us directly at (425) 556-8100 or info@emeraldcommunties.com.
• Carrier Liability: Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary.
• Data Privacy & Confidentiality: No mobile information, text messaging originator opt-in data, and consent will be shared with any third parties, partners, or affiliates for marketing or promotional purposes under any circumstances. All categories mentioned in our Privacy Policy exclude text messaging originator opt-in data and consent.

2. ELIGIBILITY

You represent and warrant that you are at least 16 years of age or the age of legal majority in your jurisdiction. If EC discovers that you do not meet this requirement, EC reserves the right to suspend or terminate your access immediately.

3. PROPRIETARY RIGHTS & LICENSE

All logos, trademarks, content, images, text, and materials appearing on this Site are the property of Emerald Communities and are protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, or modify any content without prior written permission from EC.

4. ACCOUNT REGISTRATION

If you register for an account, you agree to provide accurate information and keep your log-in details confidential. You are solely responsible for all activities that occur under your account.

5. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

THE SITE AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR TEXT MESSAGING SERVICES.

These Terms will be governed by and construed in accordance with the laws of the State of Washington without regard to conflict of law principles.
